The principal document that creates and governs a condominium corporation. It is the single most important document in the condominium after the Condominium Act and is registered in the local Land Registry Office, together with an assortment of architectural, structural and condominium plans called the Description, creating the condominium corporation. The Declaration is analogous to the Articles of Incorporation of a business corporation. It cannot be changed except by court order for an error or inconsistency or upon written consent of 100% of the owners and mortgagees in the condominium corporation.
